Faith Magee/McGee is also suggested as a possibility in "B. F. McLemore"

    James L. McLemore, III, in a posting to http://boards.ancestry.com/ notes that her maiden name is "possibly Edmonds, probably not Briggs or Magee." In his book, James explained that "one of her oldest grandchildren was named Howell, a family name or surname used frequently in the Edmunds and Briggs families as a given name; both of these families were related to Thomas Blunt (oldest son of Henry Briggs's first wife Mary, and father-in-law of Howell Edmunds) with whom, as already stated, the early McLemore family had had a close connection." (James L. McLemore, III, p. 55).

    Jim White, another researcher, states that her maiden name was Briggs.

    Faith's renunciation of John's will gave her a widow's life right in the homeplace, but she apparently died by 1771 when we find the last Virginia reference to Joel, the sale of his father's homeplace. The deed for transfer, dated March 6, 1771, and recorded March 21, 1771, was from Joel McLemore (without a spouse joining in) of "Coleton County" (Craven County?), South Carolina, to Adam FOY of Sussex. This deed (Sussex Deed Book D, p. 317) was witnessed by Burwell McLemore, among others. (James L. McLemore, III, p. 59).

  1. 2.  John McLemore, Jr. Descendancy chart to this point (1.Faith1) was born between 1719 and 1720 in Virginia; died about 1783 in Southampton County, Virginia.

    Notes:

    On September 5, 1749, a patent was issued for 100 acres on Poplar Creek to John Macklemore (Patent Book 28). This patent was probably to John Jr., however, rather than to his father, and was for land apparently adjoining that of the elder Macklemore; shortly thereafter John Macklemore Jr. and his wife Elizabeth, of newly formed Southampton County, conveyed to his father, John Sr., a tract of unspecified acreage, but apparently encompassing all of this 100 acre patent on the south side of Poplar Swamp, by deed dated and recorded January 8, 1751/2, and witnessed by Burrel Macklemore (Surry Deed Book 6 (1749-1753), p. 179). This conveyance gave John Sr. a plantation of 250 acres on Poplar Creek, on Southampton/Surry (soon to be Sussex) County line. Apparently son John no longer needed this land for himself, as his new father-in-law, William SPENCE, conveyed 80 acres, more or less (cut from a September 5, 1749 patent to him), to his daughter Elizabeth Macklemore, land which lay on the north side of "Frank's Branch", adjoining the lands of Thomas CLIFTON, William Spence and John CALTHROP, the deed therefor being dated August 28, 1750, and recorded in the Southampton County Clerk's Office on April 11, 1751 (Deed Book 1, p. 215). Shortly thereafter this same William SPENCE conveyed to his son-in-law John Macklemore (Jr.) an additional 100 acres, more of less, from the same patent, described as adjoining the aforesaid branch, CALTHROP, CLIFTON and one Capt. John RUFFIN, by deed dated October 9, and recorded October 11, 1751 (Southampton Deed Book 1, p. 266.). (James L. McLemore, III, p. 56).

    John McLemore, Jr. and his wife Elizabeth witnessed the will of Simon TURNER, dated July 7, 1761, and admitted to probate in Southampton County December 10, 1762 (Southampton Will Book 1, p. 410). (James L. McLemore, Chapter IX "Simon Turner and his Southampton County Descendants, frp, an unidentified manuscript in the possesion of Rudy Leverett.

    In addition to the land conveyed to John and Elizabeth by his father-in-law, he had other land holdings. In a deed dated January 14, 1762, he conveyed to William Watson GRAY 130 acres bounded by William TAYLOR and the William SPENCE Estate on the east, Thomas CLIFTON on the southeast, and Hugh NORVILL and Henry HARRIS on the north (Southampton Deed Book 3, p. 109). Thomas CLIFTON was the husband of his wife's sister, Sarah. A few years after the conveyence, the grantee William Watson GRAY died, and in 1770 John McLemore sued his executor, John GRAY. The verdict came back for GRAY on September 13, 1771 (Southampton Order Book 5, p. 457). A month earlier, John conveyed his 80 acre tract on the north side of Frank's Branch to Henry MOUNGER as security for a loan of 22 pounds (Southampton Deed Book 4, p. 347), but was able to repay the loan and MOUNGER released the 80 acres by deed of release (Southampton Deed Book 5, p. 209).     In a 1986 letter to Rudy Leverett, the author notes that John McLemore, Jr., along with his first cousin William McLemore, was a witness to a deed of "acquitaner" and a companion deed involving Thomas TURNER recorded May 9, 1776.

    John McLemore's will, dated December 27, 1782, and admitted to probate in the Clerk's office of Southampton County (Will Book 4, p. 15), was transcribed by James L. McLemore III as follows:

    In the name of God Amen. This 27th day of December 1782 I John McLemore of Southampton county being sick and weak in body but of sound and disposing mind and memory do make & ordain this my last will & testament in manner & form following: first & foremost: I recommend my soul to almighty God who gave it in hope of a joyful resurrection of the same. And as for what wordly goods it hath pleased God to bestow upon me I dispose of the as follows (to wit):

    Item: I give to my sons John and Joel McLemore all my land to be equally divided between them, the division to be made by my Executors hereafter to be mentioned together with whosoever they think proper to appoint, and in case either of my above mentioned sons shall die without lawfull issue or dispose of their part of said land, then I give the whole of said land to the other son above mentioned, to him and his heirs forever, but in case both of my said sons should die without lawful issue or make sale of sd land then I give my said land to my Daughters Elizabeth, Olive & McKinna McLemore to be sold & the money equally divided between them, to them and their heirs forever.

    Item: I give to my son James McLemore one bed and furniture, some pewter he has already in possesion, also all the money that he owes me except four pounds S five that he is to pay to George Ivey.

    Item: I give to my daughters Martha MORGAN & Mary NORVILL to each of them ten Shillings.

    Item: I give to my daughter Priscilla McLemore one Bed & furniture which she has in possession, and after her decease to her daughter Eliza. McLemore to her heirs forever.

    Item: I leave all the rest of my estate after my just Debts being paid to be equally divided between my wife Eliz. McLemore & three daughters Elizabeth, Olive and McKinna McLemore to them and their heirs forever.

    Notes:

    Patented 190 acres of land near his father on Poplar Creek by patent dated May 20, 1742 (Patent Book 20, p.---). As he was required to be twenty-one at the time of the patent, the latest possible date for his birth would accordingly be May, 1721. Upon this land he initially settled and lived for over thirty years. It was where he took his bride and began to raise is family. (James L. McLemore, III, p. 69).

    Burwell and Amy Maclemore had a large family: eleven children in all have been identified, but only two had their births recorded in the Albermarle Parish Register. The first was Sally, born June 2, 1754, and baptized August 25, 1754. Sponsors or godparents included her aunt and uncle, Robert and Lydia Magee, as well as Gilliam. A second daughter "Molly" (Mary) was shown in the Register as being born July 24, and baptized September 14, 1760. There was a sufficient interval in between these two for the birth of at least one other child (probably Howell), and the others followed along thereafter; John, Lucy, Lydia, Ann or Anna, Burwell Jr., Gilliam, Charles and James, probably in something close to that order, with their births running right up nearly to the outbreak of the American Revolution, when Burwell (Sr.) would have been 55, and Amy in her early to mid 40's. (James L. McLemore, III, pp. 70-71).

    By the time his family had grown this large, it became obvious that his original 190 acres patented plantation was too small (or worn out) to support such a family. Therefore, he arranged in 1775 to exchange this plantation with John Tyler (father of President John Tyler) for a larger tract. Both deeds were dated January 17, 1775, and recorded February 16, 1775. Burwell conveyed Tyler his 190 acre plantation (inaccurately described as obtained by patent dated August 20, 1740-Sussex Deed Book E, p. 295), in return for a tract of some 275 acres originally patented to Tyler and called "The Pine Log" plantation, adjoining another Tyler plantation called "Poplar" and also bounded by Daniel Harwood and the Pine Log Branch (Deed Book E, p. 274).     Burwell survived all his brothers (including Joel, who was considerably younger), and he apparently survived at least one child and his wife Amy as well. Neither his first born daughter Sally nor his wife is mentioned in his will, which was dated September 21, 1793, and admitted to probate October 4, 1798 (Sussex Will Book F, p. 123). It reads as follows:

    In the Name of God Amen. This Twenty-first day of September in the year of our Lord One Thousand Seven Hundred and Ninety-three, I Burwell Maclemore of the County of Sussex in the Parish of Albemarle being weak and low in body tho perfect mind & memory (thanks be to God for the same) but calling to mind the mortality of the body and knowing it is appointed for man once to die do make and ordaing this my last will and Testament in manner and form following (Viz) First: I give my soul to almighty God who gave it me in hope of joyous resurrection and as to my wordly Estate wherewith it hath been pleased God to bless me with I bestow in manner and form following, to wit:

    Impremis: my will and desire is that my land be laid off in three parts. I have and devise to my son, Gilliam Maclemore the lower part of my Land with the Building and extend up as far as the Spring branch and thence along the said branch to the head and thence a straight line form thence to a corner tree, a pine that stands in the upper prong of the Pine Log Branch to him and his Heirs forever.

    Item: I give and devise to my son Charles Maclemore the Land adjoining Gilliam Maclemore above the Spring branch to the Horse Meadow to the School House path and thence a straight line from that to the head line to him and his Heirs forever.

    Item: I give to my son James Maclemore all the rest of my Land adjoining Charles Maclemore between the Horse Meadow and the long Meadow branch, also my Negro boy the name of Henry also my young plantation colt to him and his heirs forever.

    Item: I give and bequeath to my Son John Maclemore the sum of Five Pounds to him and his Heirs forever.

    Item: I give and bequeath to my Daughter Lucy Bullock the sum of Five Pounds to her and her Heirs forever.

    Item: I give my daughter Ann Maclemore the sum of Five Shillings to her and her Heirs forever.

    Item: I give to my Daughter Lydia Lewis the like sum of Five Shillings to her and her Heirs forever.

    Item: I give to my Daughter Molly Land the sum of Five Pounds to her and her Heirs forever.

    Item: My will and desire is that all the rest of my Estate that is not before given to my above mentioned Children may be sold and the money arising from the Amount of Sales after paying my Just Debts and the Legacies as above mentioned may be equally Divided between Howell Maclemore and James Maclemore to them and their Heirs forever.

    Lastly: My Desire is that Gilliam Maclemore and Charles Maclemore be Executors to this my last Will and testament. Testifying this and not other to be my last will and testament. In Witness whereof I have hereunto set my hand and affixed my Seal this day and year written.     As noted above, Burwell's will, in addition to omitting any mention of his wife, Amy, also omitted his eldest daughter Sally whose birth was registered in the Albemarle Parish Register. It is accordingly presumed that neither Amy or Sally survived to the date of the execution of the will (1793), and Sally probably died in her youth, unmarried. Burwell's other four daughters share a history similar in many respects to those of his brother John. Two are named in the will by their married names, but there is no mention in the marriage records of either. They are Lucy Bullock and Lydia Lewis. Another daughter, Ann, Anna or Anny apparently did not marry; her own will, which she signed as Anny McLemore, was dated August 18, 1818, was admitted to probate January 15, 1835, in Southhampton County (Will Book 11, p. 352), referred to her brother Gilliam McLemore, but bequeathed her property to her granddaughter Susanna Carter, daughter of HER daughter Susanna Woodward! Ann survived her brother Gilliam, and was later paid by his estate then dollars for briefly keeping his children after his death. Finally Mary, or Molly as she was called in the birth records of the Parish Register and also as she was called by her father in his will, was likewise referred to by her married name, Land; she was married (as Mary McLemore) to Littleberry Land pursuant to marriage bond issued October 4, 1791 (Southhampton Marriage Register, p. 75).     Burwell had six sons to carry on the McLemore name into the 19th century in Southside Virginia. However, this was the age when farm lands in the old tobacco-growing regions of Virginia became too worn out to support growing families, while migration was taking whole families westward and southward into newly opened areas for settlement. The lure of new land, the call of McLemore cousins already emigrating southward and westward, was calling on several of the sons of Burwell Maclemore even before, and especially after, his death. Their migrations before the turn of the 19th century thus put these McLemores at the forefront of this pattern of migration, just as they had been in the Carolinas ever since the days of James and Abraham Macklemore, the original immigrant brothers. (James L. McLemore, III. pp. 73-75).

    First US Census of 1790 shows Burwell McLemore as a HOH with eight whites and two slaves.(Sussex County, Virginia). Howell was not one of them (of 11 children, Sally had died, John had moved to Carolina, and Howell and one of the older daughters had married and moved out, leaving Amy and seven children). (James L. McLemore, III, p. 75).

    Burwell's third son (at least his third to move away) was his namesake Burwell McLemore, Jr. (James L. McLemore, III, p. 76).

    Meanwhile, back in Virigina, Burwell Sr.'s other three sons were remaining at home. Gilliam McLemore received the lower third of his father's "Pine Log Plantation, with buildings. He is known to have married three times.......Charles McLemore received the second third of his father Burwell's plantation. Charles married Lucy ROWE....The last (and probably youngest) son of Burwell and Amy Maclemore was James. Born just before the outbreak of the American Revolution, he was devised the final third of his father's "Pine Log" plantation. He married Rebecca HARWOOD, ...(James L. McLemore, III, pp. 77-79).

    (Medical):Two direct descendants of Burwell participated in the Morrison yDNA study.

    The main purpose of this study was to prove that the immigrant founders of this family in America, James Macklemore and Abraham Macklemore, were brothers. If brothers, then the y-DNA of the direct male descendants of both men would match. However, instead of confirming this, it appears that we have AT LEAST two distinct yDNA groups, with three additional potential lines. The first cluster of matching yDNA has ten members, who are part of the R1b1a2 haplogroup. The R1b DNA haplogroup, is the most common in Western Europe. Two of the ten participants can trace their lines back to the immigrant Abraham Macklemore, the husband of Mary Young. Another member can trace himself back to Moses McLemore b. ca. 1738 who is thought to be a son of Wright McLemore, grandson of William Macklemore, and great-grandson of the immigrant James Macklemore. If both these members are correct in their paper trails, AND if Amos can be proven to be a great-grandson of James Macklemore, then the assumption that James and Abraham have a common paternal ancestor is correct as descendants of both men share the same yDNA. The other six members of this first cluster all have the McLemore surname, and all can trace their lineages back to McLemore men who predate the Civil War, but have not conclusively linked themselves back to either James or Abraham.

    The second cluster in the study have three members to date. They are all in the E1b1 Haplogroup, which is rare in Western Europe. All of them match each other, but do not match any other McLemores yet tested. All three of these members can trace their ancestry to John Macklemore of Virginia, the husband of Faith. Two of them descend from his son Burwell, and the third from his son Joel. But, as discussed above, IF we have also proven that the immigrants Abraham and James Macklemore are brothers, then it follows that John Macklemore could not be the biological son of the immigrant James, as the yDNA of these two clusters is very different.

    Our current thinking is that John was likely a son of Fortune's and a stepson of James Macklemore, who raised him as his own. Alternatively, it may still be proven that James and Abraham were not brothers. They may share the same surname, but not the same paternal ancestry. More proven descendants of James and Fortune Macklemore will need to be tested to confirm or refute either theory.

    Notes:

    In the process of executing her husband's will, Faith Macklemore made a distribtuion of one pound of current money to Thomas CLIFTON, the neighbor of John Macklemore, but who was not mentioned in John Sr.'s will. This distribution was actually on the behalf of their daughter Sarah Macklemore. The distribution of her bequest to Clifton indicates that he was her husband, since a married woman in that age had little in the way of property rights, and her husband had the right to receive, hold and dispose of her property. (James L. McLemore, III, p. 58). Eldon and Ann McLemore of Derby, Kansas, also show she married a CLIFTON.

    "Other, less definitive evidence tends to indicated that John's other daughter, Lydia, married Robert MAGEE, who was subsequently appointed a guardian for a McLemore orphan (a daughter of Gilliam McLemore).     He was born, according to the ALBEMARLE PARISH REGISTER, on the "7th day of the 11th month, 1739" (February 23, 1739/40), and was baptized on the "23rd day of the 12th month, 1739" (February 23, 1739/40). (James L. McLemore, III, p. 55).

    First Sheriff of Richland Co., Feb 12, 1787-89. Justice of the Peace in 1787. Inquirer and Collector of Taxes 1784-1785.

    He served two hundred eighty-four days as a captain and thirty days as a commissary under Lt. Col. Taylor and Col. Sumter during 1780 and 1781. In addition, he supplied flour during 1782. He was captured at Fishing Creek, but escaped, S.C.H.& G., XXVII, 207; A.A.5124; V219. I Joel Mclemore of Richland County & State of South Carolina, being in health of body & of Sound sence & Memory Thanks be to Almighty God for the same, but calling to mind the Mortality of my body & Knowing it is appointed unto all men once to die do make and ordain this my last will & Testament in Manner & form following.     In an April 4, 2002 email to McLemore cousin researchers, McLemore cousin Thelma Hayes provides information from the Daughters of the American Revolution's Library which genealogist James McLemore III later confirms is the "Rosetta Stone" as to the lineage of Nanny's grandfather, Joel McLemore. Both of their emails follow. The man below, Captain Joel McLemore, is Emma McLemore's (Nanny's) grandfather's grandfather - her great great grandfather.     Yesterday, I received a photocopy of the following McLemore document taken from a file located at the DAR Library in Washington DC:

    The McLemore Family in Richmond

    Captain Joel McLemore came to South Carolina before the Revolution (his wife was Miss Wyche, the same family of Mrs. T. Taylor). He planted on the Congaree Swamp about twelve miles below Columbia. He was an officer in Colonel Taylor's command and served him all through the war. He was a brave honest and upright man. He left John, James, and Joel. John married his cousin, the Widow Patrick, sister to Claiborne Clifton. The Widow Patrick had one son Curtis Clifton, and a daughter Sarah. Curtis died unmarried; Sarah married Andrew Wallace.

    Major John McLemore had by his only one wife, John and Joel and a daughter Eliza. John married a Miss McMorris who had two sons, John and Mark, and one daughter Victoria. Eliza married William Meyer, and died childless. Captain McLemore had a daughter married to William Smart who left a large family.

    Captain Joel McLemore came from Virginia, a young man, about the same time that Colonel Thomas Taylor did. He was highly educated and had property. He bought lands on the Congaree River below Columbia where he lived and died. He had four children, Major John McLemore, Joel McLemore, James McLemore, and Mrs. Smart. His son Major John McLemore lived and died on the land he inherited from his father, his descendants are now three grandchildren and their families. His son Joel McLemore moved to Tennessee where he raised a large family.

    McLemore genealogist James McLemore III responds to the above, also in an email of April 4, 2002:

    Eureka! I think you have found the Rosetta Stone for your branch, the proof we have been looking for that your Joel (b. 1801-02) was Joel III, son of Joel Jr. and wife Temperence (Goodwyn)McLemore, and so grandson of Capt. Joel McLemore who moved from Virginia to South Carolina before the death of his father John Mackelmore in 1767 back in Virginia. Since Logan County, Tn site where Temperence and her large family are found, is immediately north of the Tennessee/Kentucky State line, I am not bothered at all by the document's reference to Tennesee rather than Kentucky as the place where he (Joel Jr, Nanny's great grandfather - note by EC) settled with his "large family," nor do I consider it a problem as to where - Tennesee or Kentucky - Joel Jr. died or whether his family's move into Kentucky came before or after his death. He left South Carolina for Tennessee, and his "large family" shows up later without him just over the line in Logan Co., and this document to me is the nail in the coffin that confirms my conclusions previously stated to y'all. I now consider the matter proved and resolved, especially because the document is a notarized copy of an 1854 statement made apparently by Capt. Joel's step-grandson-in-law, the husband of his son Major John's step-daughter, and so written by the hand of one who should have had some degree of familiarity with Major John's family and therefore presumably with Capt. Joel's family too.

    What does bother me is the reference by this Andrew Wallace to Major John's "only one wife". It lists three children by her, but aside from Eliza(beth) who married William Meyer, who was probably the daughter of Cressy or Crissy Clifton Patrick (the "Widow Patrick"), daughter of his father Joel's older sister Sarah who married Thomas Clifton, the two boys had to have been born before Cressy or Crissy was widowed by her first husband Mr. Patrick and she had married Major John - or they themselves had to have married and began producing their own children while they were still pre-teen boys! The chronology just won't admit of enough time for her to have been their mother. In addition, I have other children for Capt. Joel McLemore besides the three boys and one girl mentioned by Wallace, including a possible one named Matthew who after Joel's death appears along the Georgia/South Carolina border on or near land Joel supposedly held there, and who numbered among his own descendants (like your Joel III) issue named Joel and Howell, a strong indicator of the connection.

    That is why, in addition to "the Group" I have copied in Mr. Robbie Robertson (whose e-mail address is the last in the listing above). Robbie is most interested in the Clifton Family descended from Joel's sister Sarah and her son (Crissy's brother) Claiborne Clifton (I think!). But as he has done a great deal of research into both families, I hope he can help me - us - unravel some of the confusion surrounding Capt. Joel and his family in South Carolina. That is why I also begin by sending him a copy of Thelma's find for his comment as well as his valuable instruction to us all on the actual structure of Joel's family.

    I therefore anxiously await his, and each of your, comments on Thelma's find and my comments above thereon.

    (Research):Adam Ivey left a lengthy will in Sussex County dated 3 August 1789 and proved 7 May 1792.[327] The will left 100 acres "whereon he now lives" to son Ephraim Ivey, and 110 acres "whereon he now lives" to son Peebles Ivey. (The will mentions that the 110 acres to Peebles Ivey was the tract purchased of Joel McLEMORE less 40 acres reserved for the homeplace, meaning that it was the 1725 patent to McLEMORE while the 100 acres devised to Ephraim Ivey was the 1749 patent to McLEMORE.)

    (Medical):A direct male descendant of Joel McLemore, along with two direct male descendants of his brother Burwell, were participants in the Morrison yDNA study.

    The main purpose of this study was to prove that the immigrant founders of this family in America, James Macklemore and Abraham Macklemore, were brothers. If brothers, then the y-DNA of the direct male descendants of both men would match. However, instead of confirming this, it appears that we have AT LEAST two distinct yDNA groups, with three additional potential lines. The first cluster of matching yDNA has ten members, who are part of the R1b1a2 haplogroup . The R1b DNA haplogroup, is the most common in Western Europe. Two of the ten participants can trace their lines back to the immigrant Abraham Macklemore, the husband of Mary Young. Another member can trace himself back to Moses McLemore b. ca. 1738 who is thought to be a son of Wright McLemore, grandson of William Macklemore, and great-grandson of the immigrant James Macklemore. If both these members are correct in their paper trails, AND if Amos can be proven to be a great-grandson of James Macklemore, then the assumption that James and Abraham have a common paternal ancestor is correct as descendants of both men share the same yDNA. The other six members of this first cluster all have the McLemore surname, and all can trace their lineages back to McLemore men who predate the Civil War, but have not conclusively linked themselves back to either James or Abraham.

    The second cluster in the study have three members to date. They are all in the E1b1 Haplogroup, which is rare in Western Europe. All of them match each other, but do not match any other McLemores yet tested. All three of these members can trace their ancestry to John Macklemore of Virginia, the husband of Faith. Two of them descend from his son Burwell, and the third from his son Joel. But, as discussed above, IF we have also proven that the immigrants Abraham and James Macklemore are brothers, then it follows that John Macklemore could not be the biological son of the immigrant James, as the yDNA of these two clusters is very different.

    Our current thinking is that John was likely a son of Fortune's and a stepson of James Macklemore, who raised him as his own. Alternatively, it may still be proven that James and Abraham were not brothers. They may share the same surname, but not the same paternal ancestry. More proven descendants of James and Fortune Macklemore will need to be tested to confirm or refute either theory.

McLemore to her heirs forever." Therefore it appears she either married a cousin, or was unmarried at the birth of her daughter, Eliza.


  4. 10.  John McLemore, III Descendancy chart to this point (2.John2, 1.Faith1) was born after 1750 in Southampton County, Virginia; died after 1815.

    Notes:

    Probably the oldest of John McLemore's three sons. His father had devised his plantation to Joel and John, with the division between them to be made by his executors. No record has been found of this division, but thereafter the two appear to treat their shares separately. Joel seems to have ended up with the 80 acres, more or less, lying on the north side of Frank's Branch, while John must have received the remaining part (100 acres, more of less) lying south of the branch. (James L. McLemore, III, p. 63)

    Apparently John III's only deed record was a chattel mortgage in which he conveyed certain personal property to Humphrey DREWRY to secure the latter 42 pounds in current money of Virginia. This instrument was dated April 8, 1797, and recorded October 16, 1797 (Southampton Deed Book 8, p. 681). He made no conveyance of any land during his lifetime, and apparently what he received from his father he died with. It uncertain when John died, but the same Humphrey DREWRY qualified before the Southampton County Court on February 20, 1815, on the estate of John McLemore, presumably John III (Southampton Order Book 13, p. 63); it is undoubtedly the same John McLemore who gave the chattel morgage above. (James L. McLemore, III, p. 64). James L. McLemore, III goes on to detail some conflicting, but undocumented information, that John MAY have still been alive at the time of death of his brother James, said to be dated September 17, 1820.

    Of this James little is known. A single reference entered on March 21, 1805, in Southampton County (Order Book 10, p. 446) provided that "on motion of James McLemore a witness for John HARRIS against Joseph HARRISON it is ordered that the said John HARRIS pay him fifty-three cents for on day's attendance on this court according to the law." It is probably that this refers to James, son of John Jr., rather than James the son of John III (who was too young), or James, the son of Burwell of Sussex County, even though the latter (and/or his son James) moved across the line into Southampton County sometime afterwards.

    According to information on his will provided by Dorothy McLEMORE, James had a wife named Lucinda, but was survived by no children. (James L. McLemore, III, p. 65). Eldon and Ann McLemore of Derby, Kansas, also show he married a Lucinda.

Jim therefore presumed that neither Amy or Sally survived to the date of the execution of the will (1793), and Sally probably died in her youth, unmarried. (James L. McLemore, III, p. 73). Her baptism sponsors were her Aunt and Uncle, Robert and Lydia Magee, as well as a Gilliam.

    Jim White (jim4@whitesnet.net) indicates, however, that Sally did survive her childhood, m: Henry Harrison & died before 1780 Southampton County Virginia.

    (Research):Burwell and Amy McLemore had a large family: eleven children in all have been identified, but only two had their births recorded in the Albemarle Parish Register. The first was Sally, born June 2, 1754, and baptized August 25, 1754. Sponsors or godparents included her aunt and uncle, Robert and Lydia MAGEE, as well as a GILLIAM. (James L. McLemore, III, p. 70).

    James L. McLemore, III writes that "Charles received the second third of his father Burwell's plantation. Charles married Lucy ROWE, daughter of John ROWE...He died just over twenty years later, and his will dated July 29, 1818, was admitted to probate in Sussex County on October 15, 1818 (Sussex Will Book H, p. 527). In it he named five children: Richard McLemore, who married Mildred A. BRITT....and who owned (and mortgaged) land in Greensville County; William S. McLemore, who sold his share in his father's estate in 1826 (Sussex Deed Book P, p. 23), and disappears from the records (presumably moving away); Mary Ann McLemore, who married Jesse SLEDGE...; Martha McLemore who married James DUNN of Greensville County...her brother William S. acting as security on their bond...and Frances L. "Fanny" McLemore, who was married to Thomas NEWTON... Charles' widow Lucy was left all property for her lifetime with which to raise and educate the children until the youngest turned 21. She herself died intestate in about 1838 (Southampton Order Book 18, p. 459)."

    James L. McLemore suspected, due to Charles's baptism information not being recorded in the Albermarle Parish Register, that Charles was one of the younger sons of Burwell and Amy, born in the late 1760's or early 1770's.

    However, Jim White (jim4@whitesnet.net) emailed that "Charles McLemore was born before 1760, administered his father's estate - He married twice, 1st, Hardy Sammons December 30, 1783 - He had several children by her. He did marry as his 2nd wife, Lucy Rowe, October 16, 1797."

    Charles married Lucy Rowe on 16 Oct 1797 in Southampton County, Virginia. Lucy was born before 1777; died about 1838 in Southampton County, Virginia. [Group Sheet] [Family Chart]

    Notes:

    James L. McLemore, III writes that "John was probably the next oldest son, but there is no other record of him in the Southside clerk's office other than the bequest of cash to him under his father's well. Because of this, and because most other Southhampton Co references to a John McLemore of this generation are ascribed to John III, son of Burwell's brother John Jr, it is generally assumed that Burwell's son is the John McLemore who lived for a time in NC, and fought in the Revolution, and died in Tennessee. It is said John was born in about 1762 in Brunswick Co, VA, which was just a short way southwest of Burwell Maclemore's land in Sussex County."

    As Jim McLemore indicated above, It has long been assumed that the John McLemore who lived for a time in NC, fought in the Revolution, died in Tennessee (and was the father of Archibald McLemore), was a a son of Burwell MacLemore and Amy Gilliam. However, current DNA evidence indicates this is not correct.

    There is currently no evidence to explain what happened to this John McLemore. There is no proof he married, and if he did marry no proof of his wife was, and no evidence to identify the lady - John McLemore paid taxes 1790 and 1798 in Southampton County Virginia. He was living when his father's estate was proved in Southampton County Court.

    Larry Willis emailed on December 28, 2009 that his wife's line is from Grover Cleveland McLemore 1884-1959; son of Andrew D. 1841-1927: son of Greene 1800-1850; son of John 1762-1844; son of Burwell 1721-~1793; son of John 169-1767. He said he had been talking to Tom Heseltine about the DNA project and there are several male cousins in and around Knoxville, TN.


  14. 20.  Howell McLemore Descendancy chart to this point (3.Burwell2, 1.Faith1) was born about 1762 in Virginia; died on 16 Feb 1807 in Southhampton County, Virginia.

    Notes:

    There was a sufficient interval in between these two [Sally and Mary] for the birth of at least one other child (probably Howell), and the others followed along thereafter.... (James L. McLemore, III, p. 71).

    Howell married Lucy HARRIS, marriage bond issued 13 Feb 1786 from Sussex County Court Clerk's office (Sussex Marriage Register, p 42), but the officiating minister filed his return showing the marriage was celebrated on 28 Feb 1785. No other McLemore marriages record appears in any Southside Virginia clerk's office dated earlier than this.

    First US Census of 1790 shows Howell McLemore as living in Halifax County, NC, which had been formed earlier from the northern portions (along Roanoke River, where the early McLemore land holdings had been) of Edgecombe County. That census listing showed his home consisted of 2 males over the age of 16, one male under 16, and 3 females.

    Apparently, however, Howell kept a foot in each location, so to speak; in 1880 he was involved in the probate of the estate of Thomas Parker in Northampton CO, NC. By 1804, apparently his wife Lucy had died for back in Southhampton Co, VA Howell McLemore was "by the Court appointed guardian to Joel, Polly, Lewis and Burwell McLemore, children of sd McLemore" on Oct 15, 1804 (Southhampton Order Book 10, p 312), indicating his wife had died owning sufficient estate that passed to them to necessitate their father's appointment as their legal guardian. On 16 Feb 1807, a new guardian had to be appointed for these same four children, who were still minors, indicating that Howell himself was now probably dead, he would have been abour 50 years old, more or less, at about that time. (James L. McLemore, III, p. 75). Jim White (jim4@whitesnet.net) indicates that Howell's date of birth was around 1762.

    The book "The Heritage of Lauderdale County, Alabama" does not list a Howell as a child of Burwell and Amy (Gilliam) McLemore, listing in his place a son named James.

    Eldon and Ann McLemore of Derby, Kansas, also show that Howell married Lucy HARRIS, and that they were the parents of Joel (who married cousin Nancy McLemore, daughter of Joel McLemore and Elizabeth Thomas), Polly, Lewis and Burwell.

    Notes:

    Burwell's third son (at least his third to move away) was his namesake Burwell McLemore Jr. Born not later than about 1770, he married Mary GLOVER, daughter of Jones Glover Sr. pursuant to a marriage bond made out November 6, 1794 (Sussex Marriage Register, p. 75). Mary was the mother of his older children, but at least five of more of his fifteen children were by his second wife, Nancy. He may have lived in Ohio for a while, as his eldest son Robert J. is said to have been born there in 1795. He then moved to North Carolina where his second son Howell was born in 1801. He apparently moved to Tennessee shortly thereafter, as his third son Briggs M. McLemore was born there about 1803. At this point the sources are confusingly in conflict. It is generally held that Burwell moved to Lauderdale County, Alabama, where his fourth son Maclin H. McLemore was born in about 1804. However, U.S. Census records apparently put him still in Giles County, Tennessee, as late as 1820; perhaps he returned there for some reason. At any rate, then came two girls, Barbary in 1805, and Mary J. in 1808. The order of the births for the next several children is uncertain; a possible listing of them: ??? McLemore House (ca. 1810), Martin A.P McLemore (ca. 1812), Sarah McLemore Lambert (ca. 1815), and Margaret McLemore Marks (ca. 1818). Perhaps one or two, perhaps more, of these four were children of his second wife.

    Burwell died within a year of this Census (1850-1851), as a suit was brought in Lauderdale County court, July term, 1851, for sale of his lands, in which his heirs were named as parties. The married names of some of Burwell's daughters were obtained from these papers. In addition, the spouses of several children are also generally known, Robert married Ruthea THORNBERRY in 1832 and Howell married her sister Mildred in 1828, Briggs married Mary SPIGAL or STEGAL in 1833, MACLIN married Nancy HALBERT in 1843; Mary J. married Gabriel DAVIS in 1827, Sarah married James LAMBERT, Margaret married Henry MARKS, and Barbary married a man named POTEET.     In "The Heritage of Lauderdale County, Alabama," the Alabama State Plat Book, page 43, is cited, showing that Burwell had purchased 160 acres on May 23, 1828. His land was West of Elk River T3S R7W NW Sec 11. Burwell and his family were among the oldest settlers to come to Lauderdale County, and he lived (in Lauderdale) until his death. On Feb. 21, 1840, he purchased 210 acres from Martin Harkins. This land was also in range 7, T3 sec 15 which is close to Elk River at Rogersville. The book further states that Burwell left a will in Lauderdale Co dated July 1, 1844 naming six living children by his second marriage as well as six living children by his first marriage. He is believed to be buried in the Womack cemetery in Rogersville. This cemetery is believed to to be on some of the land he owned.

    Notes:

    The inventory of Gilliam's estate was filed in Sussex County May 5, 1814, and a first accounting filed August 3, 1815, showed $10 paid to his sister Anna for keeping his children briefly, and accounts were paid to his brother James and to the latter's father-in-law, Daniel Harwood as well. In about 1815 or 1816 Sylvia McLemore, widow of Gilliam McLemore, filed suit against his administrator. In this suit all six children were named, probably in the order of their births: Amy, Polly, Henry, Burwell G., Betsey and Rebecca.

    Polly and Betsey are not found elsewhere in the records, except that is is possible that Polly was the Mary who married Turner NEWTON in March 1827 (Sussex Marriage Register, p. 371), since her cousin Fanny (Frances L.) married Thomas NEWTON. However, the "Mary" in this Marriage record, even if called by the nickname Polly, could also have been the daughter of Howell McLemore or John McLemore III.

    Henry apparently died before reaching his teenage years, probably in late 1815. An accounting of his estate with first entry on December 25, 1815, was filed on May 7, 1829 (Sussex Will Book L, p. 155).

    "The last (and probably youngest) son of Burwell and Amy Maclemore was James. Born just before the outbreak of the American Revolution, he was devised the final third of his father's "Pine Log" plantation. Twenty years after his father's death he sol most of his inheritance from his father to Edward REESE by deed dated May 24, 1817, and recorded April 2, 1818 (Sussex Deed Book M, p. 313). He then sold the balance of his inherited lands by deed, in which his wife Rebecca joined, to Joel HAILES dated February 26, 1825, and recorded March 3, 1825 (Sussex Deed Book O, p. 264). By this time, James was probably at least fifty years old, perhaps more. He thereafter disappears from the records without further trace, but is presumed to have died intestate sometime during the next decade or so, rather than moved away, because of his age and because of his children who remained in the area will into the 1840's or longer.     Major John McLemore was a prominent man and a wealthy man. He had a large plantation adjoining the plantation of Col. David Myers and Myers son married a daughter of Maj. McLemore. There was a murder and Maj. McLemore spent his fortune defending his life for killing Col. David Myers. From the graveyard of Col. Myers: "Col. David Myers was inhumanely murdered by John McLemore" reads part of inscription on the headstone.

    John McLemore's Will was signed 25 Jan 1837, Proved 6 Feb 1837, Richland Co, SC. Named in John McLemore's Will: Cressy McLemore, wife; Eliza A. Myers, wife of William M.     Eldon and Ann McLemore of Derby, Kansas instead show him as dying ca 1848 in Rankin, Mississippi, and marrying Winnie Baltice, whom was said to be a full blooded Choctaw. They show John and Winnie as the parents of Wesley, Reubin, Matthew, Dorcus (m. to. Wm. Whitehead), John and Robert. They may be confusing him with Moses McLemore, who was married to Nancy (Vinnie) Batiste, believed to be a Choctaw Indian, and lived in Copiah County, Mississippi.

My parents live in Athens, Limestone County, AL and I live in Huntsville, Madison County, AL. I'm not sure all the children were mentioned in a will, or even if there was one, but they were mentioned in an estate inventory. Burrell was about 80 years old when they moved to Alabama and his wife had him give all the land and slaves to their children. When he died there wasn't enough money left to settle his debts. I would assume that he had already given property to children of his first marriage. Burrell was probably well-to-do as he was very active in the slave trade in the Nashville area. If there is anything else I can help with just let me know."

    "One day [John McLemore]...was with his Uncle Maclin Bass McLemore in Rogersville. Maclin was a pilot on the Shoals. The Shoals, being a treacherous body of water and rapids, took a skilled person to navigate. That fateful day John and Maclin were captured by the army. Thinking John was too young (he was 15); he was told to go home and tell his aunt what had happened to her husband. Legend has it that Maclin was never heard from again." (The Heritage of Lauderdale County, Alabama, p. 347).

    He built a dogtrot house with one side log and the other frame, surrounded by large trees and log dependencies in an ideal rural setting. When Maclin McLemore returned from the ardous task of piloting boats over the treacherouse Tennessee River Shoals, he liked to prop his feet up in comfort. He found that comfortable place in the story-and-a-half dogtrot house which he built around the time of his marriage in 1843. (The Lure and Lore of Limestone County, p. 147)

    Notes:

    Probably their oldest son, even though he was not born for nearly five years after their marriage. According to the marriage records for his last marriage, he was 55 years old at the time of the marriage, June 6, 1855, thereby placing his birth between June 7, 1799, and June 6, 1800; family records and tradition on the other hand give his birth date as 1801...His first appearance in the court records, however, was while serving as trustee on a deed of trust dated January 1, 1827 (Southampton Deed Book 20, p. 128), although it is possible that this reference could be to his father.

    Meanwhile earlier in that same year James purchased a large tract of 484 1/4 acres by deed from Fielding ROSE and wife dated December 29, 1838, and recorded January 21, 1839. This land was described as bounded by Rose's Swamp, Fitzhugh and the Public Path, Capt. Newt. HARRIS (dec'd), Peter EDWARDS and Nathaniel FRANCIS (Southampton Deed Book 24, p. 301). He thereupon gave a purchase money deed of trust on the property of $1,281.12 on a note. After only seven years, however, James found he could not pay this indebtedness off, and he and his wife Martha conveyed his equity in the property to WILLIAMSON by deed dated December 27, 1845, and recorded April 20, 1846 (Southampton Deed Book 26, p. 529), thereby ending his days as a landowner. Thereafter he continued to farm, either on rented land or for others, on his 1855 marriage license he listed his occupation as "overseer."

    Sometime between 1846 and 1855 Martha Barkley McLemore died, and James took a second wife, a Miss FELTS, according to family tradition. However, no marriage license for this union was ever found. This second wife apparently died, without issue, not too long after that, and in 1855 James married Elizabeth RAMSEY, the daughter of Jacob and Sarah RAMSEY, who was then twenty years his junior. Their marriage took place in Southampton County on June 6, 1855, the Rev. M.A. Longhorn presiding.

    The last record involving this James McLemore is an 1873 chattel mortgage given to Dr. Thomas B. POWELL (Southampton Deed Book 31, p. 612), so it is known that he survived the Civil War. Family records and tradition give his date of death as 1877, but not record of his death appears in the Southampton County court records. Neither he nor his father left wills, nor were their estates administered, which has made the identification of all their children difficult. If he had had a will, however, it may not have helped much, as several of his children died in infancy. The identity of the true mother is not known with respect to several of James' children, much less the correct order of their births, but since only three of his children apparently survived to become married, only their mothers' identities are important and in each case theirs are known.

    Within only a short time after his marriage Howell McLemore died intestate, and Alexander McLemore qualified as administrator of his estate on June 17, 1844 (Southampton Order Book 20, p. 173), and on December 15, 1845, William GOODWYN was appointed special commissioner to examine and settle Alexander's account of Howell's estate (Southampton Order Book 20, p 333).     The only mention of Tracy or Theresa in the records was when she served as witness at the wedding of her sister, Sarah Elizabeth McLemore, to Lewis HARRIS in 1843. She supposedly died without every marrying or having issue. (James L. McLemore, III, p 80).

    As of the 1880 census, she was living with her nephew and his wife, Benjamin and Rosa McLemore of Southampton, Virigina.

    Ann and Eldon McLemore of Derby, Kansas show Eldon's ancestor as John McLemore, born ca 1775 in South Carolina, and as the son of Joel McLemore and Elizabeth Wyche of South Carolina. Other records, however, show that Joel and Elizabeth McLemore's son, Major John McLemore (born ca 1776), was married to Cressy McLemore [nee Lucretia Clifton]. Eldon's ancestor was instead married to a Winnie Baltice and had a large family, sons Wesley, Rueben, Matthew and John, and daughter Dorcus. Their branch of the McLemore family moved to northern Mississippi, and then onto Oklahoma. Could this actually be the John McLemore from whom Weldon descends?

AVENT, viz; Austin, senior, Cynthia, Emannel, Daniel and Chaney, with an equal share of the proceeds of the sale of property, which I shall empower my executors to sell, with the exception of five hundred dollars, to be taken out of the part of my daughter, of the the money that may remain, after paying my just debts; the balance of my negroes, I wish to be equally divided among my wife and her child James Henry, and the one with which she is now pregnant. It is my wihd and desire that should I die shortly, that my executors sell the lots and houses I own in the town of Halifax, upon such credits as may seem to them best calculated to enhance the value of the property, together with all household and kitchen furnitre; and, at the end of the year, I wish them to sell my land, lying below the town of Halifax, and all my stock, crop and plantation utensils; the manner of selling, I leave to my extecutors; and, after the payments of my debts, the surplus, if any, I wish to be equally divided between my wife Elizabeth and her children; and the part which I design for my daughter, with the exception of five hundred dollars aforesaid, to my friend Henry Doggett, as aforesaid, in trust for the support and maintenance of my daughter, Mary E. She qualified on Harrison's intestate estate on July 22, 1822, with Richard Harrison and Alexander Peete as her sureties (Southampton Order Book 16, p. 19), filed her inventory and appraisal of his estate on October 21, 1822 (Southampton Order Book 16, p. 133), and won a law suit in her fiduciary capacity on the same date (October 20, 1823) as she bound out her son.     Both Mary and James are noted as having attended school during the year. It appears very likely that they were the orphaned children of John and Caroline McLemore, who were residents of Logan County, Kentucky at the 1850 census, but can not be found in 1860.

    Assumed to be part of the "large family" raised by Joel and Temperence McLemore based on his age and census location. Not proven.

    John and Caroline and their four children can be found on the 1850 census, but as of 1860 the family is no longer together. It appears likely that John and Caroline died prior to this date, and that their children were scattered among differing families in Logan County. Hiram D, the oldest, was a boarder in the Lamb home. John, the next eldest, was living with his first cousin, David J. McLemore. The two youngest, Mary and James, were living in the home of their presumed uncle, Goodwin McLemore.
