  1. 1.  Amy Gilliam was born about 1730 in Surry County, Virginia; died before 1793 in Sussex County, Virginia.

    Notes:

    In his book, James L. McLemore, III writes that Burwell's "wife's given name was Amy, and though it has not yet been established, her maiden name was almost certainly GILLIAM. She could have been a younger daughter of John GILLIAM Jr. (who had an Amy among his younger children), but it is more likely that her father was Charles GILLIAM, the son of Hinchea and Fortune (Flood) GILLIAM, who were all neighbors of the McLemores. Charles and Mary (CLANTON) GILLIAM are listed in the "Albemarle Parish Register" as being the parents of five children: Fortune (b. 1742), Lydia (b. 1744), Phoebe and John, twins, (b. 1751) and Jordan (b. 1757). These were their youngest five children; it is known that they had at least two other children: Charles Jr. (the oldest) and Edmund, to both of whom Charles Sr. gave land. His gift to Edmund in 1757 indicates a probable birth date for him of 1736 or before, with Charles Jr. certainly older than that. Amy (GILLIAM) McLemore, if indeed an older child of Charles GILLIAM Sr., would probably have been born sometime in the (early) 1730's.........There is no proof that he (Charles GILLIAM) had a daughter named Amy. However, Charles GILLIAM was security on the bond of Burwell's mother Faith when she qualified on the estate of her husband John MACKLEMORE in early 1767, and then himself died later that same year. In addition, Amy is a name used within both the GILLIAM and CLANTON families, Burwell and his wife Amy had a close association with both of these families, and they named two of their younger sons Charles and Gilliam, all of which tends to support this thesis (James L. McLemore, III, pp. 69, 70).

    Notes:

    As noted, Burwell's will, in addition to omitting any mention of his wife, Amy, also omitted his eldest daughter Sally whose birth was registered in the Albemarle Parish Register. Jim therefore presumed that neither Amy or Sally survived to the date of the execution of the will (1793), and Sally probably died in her youth, unmarried. (James L. McLemore, III, p. 73). Her baptism sponsors were her Aunt and Uncle, Robert and Lydia Magee, as well as a Gilliam.

    Jim White (jim4@whitesnet.net) indicates, however, that Sally did survive her childhood, m: Henry Harrison & died before 1780 Southampton County Virginia.

    (Research):Burwell and Amy McLemore had a large family: eleven children in all have been identified, but only two had their births recorded in the Albemarle Parish Register. The first was Sally, born June 2, 1754, and baptized August 25, 1754. Sponsors or godparents included her aunt and uncle, Robert and Lydia MAGEE, as well as a GILLIAM. (James L. McLemore, III, p. 70).

    Notes:

    James L. McLemore, III writes that "Charles received the second third of his father Burwell's plantation. Charles married Lucy ROWE, daughter of John ROWE...He died just over twenty years later, and his will dated July 29, 1818, was admitted to probate in Sussex County on October 15, 1818 (Sussex Will Book H, p. 527). In it he named five children: Richard McLemore, who married Mildred A. BRITT....and who owned (and mortgaged) land in Greensville County; William S. McLemore, who sold his share in his father's estate in 1826 (Sussex Deed Book P, p. 23), and disappears from the records (presumably moving away); Mary Ann McLemore, who married Jesse SLEDGE...; Martha McLemore who married James DUNN of Greensville County...her brother William S. acting as security on their bond...and Frances L. "Fanny" McLemore, who was married to Thomas NEWTON... Charles' widow Lucy was left all property for her lifetime with which to raise and educate the children until the youngest turned 21. She herself died intestate in about 1838 (Southampton Order Book 18, p. 459)."

    James L. McLemore suspected, due to Charles's baptism information not being recorded in the Albermarle Parish Register, that Charles was one of the younger sons of Burwell and Amy, born in the late 1760's or early 1770's.

    However, Jim White (jim4@whitesnet.net) emailed that "Charles McLemore was born before 1760, administered his father's estate - He married twice, 1st, Hardy Sammons December 30, 1783 - He had several children by her. He did marry as his 2nd wife, Lucy Rowe, October 16, 1797."

    Finally Mary, or Molly as she was called in the birth records of the Parish Register and also as she was called by her father in his will, was likewise referred to by her married name, Land; she was married (as Mary McLemore) to Littleberry Land pursuant to marriage bond issued October 4, 1791 (Southhampton Marriage Register, p. 75).     Jim White (jim4@whitesnet.net) emailed that Mary (Molly) 24 Jul 1760 actually married first Gilliam Jordan and second Littleberry Land & died after 1830 Halifax County North Carolina.

    Notes:

    James L. McLemore, III writes that "John was probably the next oldest son, but there is no other record of him in the Southside clerk's office other than the bequest of cash to him under his father's well. Because of this, and because most other Southhampton Co references to a John McLemore of this generation are ascribed to John III, son of Burwell's brother John Jr, it is generally assumed that Burwell's son is the John McLemore who lived for a time in NC, and fought in the Revolution, and died in Tennessee. It is said John was born in about 1762 in Brunswick Co, VA, which was just a short way southwest of Burwell Maclemore's land in Sussex County."

    As Jim McLemore indicated above, It has long been assumed that the John McLemore who lived for a time in NC, fought in the Revolution, died in Tennessee (and was the father of Archibald McLemore), was a a son of Burwell MacLemore and Amy Gilliam. However, current DNA evidence indicates this is not correct.

    There is currently no evidence to explain what happened to this John McLemore. There is no proof he married, and if he did marry no proof of his wife was, and no evidence to identify the lady - John McLemore paid taxes 1790 and 1798 in Southampton County Virginia. He was living when his father's estate was proved in Southampton County Court.

    Larry Willis emailed on December 28, 2009 that his wife's line is from Grover Cleveland McLemore 1884-1959; son of Andrew D. 1841-1927: son of Greene 1800-1850; son of John 1762-1844; son of Burwell 1721-~1793; son of John 169-1767. He said he had been talking to Tom Heseltine about the DNA project and there are several male cousins in and around Knoxville, TN.

    Notes:

    There was a sufficient interval in between these two [Sally and Mary] for the birth of at least one other child (probably Howell), and the others followed along thereafter.... (James L. McLemore, III, p. 71).

    Howell married Lucy HARRIS, marriage bond issued 13 Feb 1786 from Sussex County Court Clerk's office (Sussex Marriage Register, p 42), but the officiating minister filed his return showing the marriage was celebrated on 28 Feb 1785. No other McLemore marriages record appears in any Southside Virginia clerk's office dated earlier than this.

    First US Census of 1790 shows Howell McLemore as living in Halifax County, NC, which had been formed earlier from the northern portions (along Roanoke River, where the early McLemore land holdings had been) of Edgecombe County. That census listing showed his home consisted of 2 males over the age of 16, one male under 16, and 3 females.

    Apparently, however, Howell kept a foot in each location, so to speak; in 1880 he was involved in the probate of the estate of Thomas Parker in Northampton CO, NC. By 1804, apparently his wife Lucy had died for back in Southhampton Co, VA Howell McLemore was "by the Court appointed guardian to Joel, Polly, Lewis and Burwell McLemore, children of sd McLemore" on Oct 15, 1804 (Southhampton Order Book 10, p 312), indicating his wife had died owning sufficient estate that passed to them to necessitate their father's appointment as their legal guardian. On 16 Feb 1807, a new guardian had to be appointed for these same four children, who were still minors, indicating that Howell himself was now probably dead, he would have been abour 50 years old, more or less, at about that time. (James L. McLemore, III, p. 75). Jim White (jim4@whitesnet.net) indicates that Howell's date of birth was around 1762.

    The book "The Heritage of Lauderdale County, Alabama" does not list a Howell as a child of Burwell and Amy (Gilliam) McLemore, listing in his place a son named James.

    Eldon and Ann McLemore of Derby, Kansas, also show that Howell married Lucy HARRIS, and that they were the parents of Joel (who married cousin Nancy McLemore, daughter of Joel McLemore and Elizabeth Thomas), Polly, Lewis and Burwell.

    Howell witnessed a Will in Northampton County, NC in 1797.

    Description: "Will 444 pg 162 Thomas PARKER 26 September 1797 December Court 1797 To my sons Richard PARKER and my friends John M. BINFORD, James BRADLEY and James EXUM 1 Negro girl and her increase on the condition that they hold said Negro and increase to the sole and separate use and benefit of my Grand Daughter Mason HALL and deliver same to her when said Mason is of age or marries to son Richard (and friends as listed above) Negroes to the use of daughter Mason HALL without interference of control of her husband Leonard HALL, the said Negroes not be subject to payment of said Leonard
    HALL'S debts at death of said daughter, trustees to hold said Negroes for use of benefit of all said daughter's children (names not given) until eldest is of age or children marry to my son Richard all and every part

    James McLemore writes that "Another daughter, Ann, Anna or Anny apparently did not marry; her own will, which she signed as Anny McLemore, was dated August 18, 1818, was admitted to probate January 15, 1835, in Southhampton County (Will Book 11, p. 352), referred to her brother Gilliam McLemore, but bequeathed her property to her granddaughter Susanna Carter, daughter of HER daughter Susanna Woodward! Ann survived her brother Gilliam, and was later paid by his estate ten dollars for briefly keeping his children after his death. (James L. McLemore, III, p. 73)"

    Jim White (jim4@whitesnet.net) instead believes, however, that Anna m: 1st. John Lewis - no children - m: 2nd Hanson (Ransom?) Carter (daughter Susannah) & died before January 15, 1835 Southampton County Virginia.

  9. 10.  Burwell McLemore, Jr. Descendancy chart to this point (1.Amy1) was born about 1770 in Virginia; died after 22 Jan 1851 in Rogersville, Lauderdale County, Alabama.

    Notes:

    Burwell's third son (at least his third to move away) was his namesake Burwell McLemore Jr. Born not later than about 1770, he married Mary GLOVER, daughter of Jones Glover Sr. pursuant to a marriage bond made out November 6, 1794 (Sussex Marriage Register, p. 75). Mary was the mother of his older children, but at least five of more of his fifteen children were by his second wife, Nancy. He may have lived in Ohio for a while, as his eldest son Robert J. is said to have been born there in 1795. He then moved to North Carolina where his second son Howell was born in 1801. He apparently moved to Tennessee shortly thereafter, as his third son Briggs M. McLemore was born there about 1803. At this point the sources are confusingly in conflict. It is generally held that Burwell moved to Lauderdale County, Alabama, where his fourth son Maclin H. McLemore was born in about 1804. However, U.S. Census records apparently put him still in Giles County, Tennessee, as late as 1820; perhaps he returned there for some reason. At any rate, then came two girls, Barbary in 1805, and Mary J. in 1808. The order of the births for the next several children is uncertain; a possible listing of them: ??? McLemore House (ca. 1810), Martin A.P McLemore (ca. 1812), Sarah McLemore Lambert (ca. 1815), and Margaret McLemore Marks (ca. 1818). Perhaps one or two, perhaps more, of these four were children of his second wife.

    Burwell died within a year of this Census (1850-1851), as a suit was brought in Lauderdale County court, July term, 1851, for sale of his lands, in which his heirs were named as parties. The married names of some of Burwell's daughters were obtained from these papers. In addition, the spouses of several children are also generally known, Robert married Ruthea THORNBERRY in 1832 and Howell married her sister Mildred in 1828, Briggs married Mary SPIGAL or STEGAL in 1833, MACLIN married Nancy HALBERT in 1843; Mary J. married Gabriel DAVIS in 1827, Sarah married James LAMBERT, Margaret married Henry MARKS, and Barbary married a man named POTEET. (James L. McLemore, III. pp 76-77).

    In "The Heritage of Lauderdale County, Alabama," the Alabama State Plat Book, page 43, is cited, showing that Burwell had purchased 160 acres on May 23, 1828. His land was West of Elk River T3S R7W NW Sec 11. Burwell and his family were among the oldest settlers to come to Lauderdale County, and he lived (in Lauderdale) until his death. On Feb. 21, 1840, he purchased 210 acres from Martin Harkins. This land was also in range 7, T3 sec 15 which is close to Elk River at Rogersville. The book further states that Burwell left a will in Lauderdale Co dated July 1, 1844 naming six living children by his second marriage as well as six living children by his first marriage. He is believed to be buried in the Womack cemetery in Rogersville. This cemetery is believed to to be on some of the land he owned.

    Notes:

    The inventory of Gilliam's estate was filed in Sussex County May 5, 1814, and a first accounting filed August 3, 1815, showed $10 paid to his sister Anna for keeping his children briefly, and accounts were paid to his brother James and to the latter's father-in-law, Daniel Harwood as well. In about 1815 or 1816 Sylvia McLemore, widow of Gilliam McLemore, filed suit against his administrator. In this suit all six children were named, probably in the order of their births: Amy, Polly, Henry, Burwell G., Betsey and Rebecca.

    Polly and Betsey are not found elsewhere in the records, except that is is possible that Polly was the Mary who married Turner NEWTON in March 1827 (Sussex Marriage Register, p. 371), since her cousin Fanny (Frances L.) married Thomas NEWTON. However, the "Mary" in this Marriage record, even if called by the nickname Polly, could also have been the daughter of Howell McLemore or John McLemore III.

    Henry apparently died before reaching his teenage years, probably in late 1815. An accounting of his estate with first entry on December 25, 1815, was filed on May 7, 1829 (Sussex Will Book L, p. 155).

    Gilliam married Anne Marks on 19 May 1800 in Southampton County, Virginia. Anne was born before 1780; died before 1809. [Group Sheet] [Family Chart]

    Notes:

    "The last (and probably youngest) son of Burwell and Amy Maclemore was James. Born just before the outbreak of the American Revolution, he was devised the final third of his father's "Pine Log" plantation. Twenty years after his father's death he sol most of his inheritance from his father to Edward REESE by deed dated May 24, 1817, and recorded April 2, 1818 (Sussex Deed Book M, p. 313). He then sold the balance of his inherited lands by deed, in which his wife Rebecca joined, to Joel HAILES dated February 26, 1825, and recorded March 3, 1825 (Sussex Deed Book O, p. 264). By this time, James was probably at least fifty years old, perhaps more. He thereafter disappears from the records without further trace, but is presumed to have died intestate sometime during the next decade or so, rather than moved away, because of his age and because of his children who remained in the area will into the 1840's or longer. My parents live in Athens, Limestone County, AL and I live in Huntsville, Madison County, AL. I'm not sure all the children were mentioned in a will, or even if there was one, but they were mentioned in an estate inventory. Burrell was about 80 years old when they moved to Alabama and his wife had him give all the land and slaves to their children. When he died there wasn't enough money left to settle his debts. I would assume that he had already given property to children of his first marriage. Burrell was probably well-to-do as he was very active in the slave trade in the Nashville area. If there is anything else I can help with just let me know."

    "One day [John McLemore]...was with his Uncle Maclin Bass McLemore in Rogersville. Maclin was a pilot on the Shoals. The Shoals, being a treacherous body of water and rapids, took a skilled person to navigate. That fateful day John and Maclin were captured by the army. Thinking John was too young (he was 15); he was told to go home and tell his aunt what had happened to her husband. Legend has it that Maclin was never heard from again." (The Heritage of Lauderdale County, Alabama, p. 347).

    He built a dogtrot house with one side log and the other frame, surrounded by large trees and log dependencies in an ideal rural setting. When Maclin McLemore returned from the ardous task of piloting boats over the treacherouse Tennessee River Shoals, he liked to prop his feet up in comfort. He found that comfortable place in the story-and-a-half dogtrot house which he built around the time of his marriage in 1843. (The Lure and Lore of Limestone County, p. 147)

    Notes:

    Probably their oldest son, even though he was not born for nearly five years after their marriage. According to the marriage records for his last marriage, he was 55 years old at the time of the marriage, June 6, 1855, thereby placing his birth between June 7, 1799, and June 6, 1800; family records and tradition on the other hand give his birth date as 1801...His first appearance in the court records, however, was while serving as trustee on a deed of trust dated January 1, 1827 (Southampton Deed Book 20, p. 128), although it is possible that this reference could be to his father.

    Meanwhile earlier in that same year James purchased a large tract of 484 1/4 acres by deed from Fielding ROSE and wife dated December 29, 1838, and recorded January 21, 1839. This land was described as bounded by Rose's Swamp, Fitzhugh and the Public Path, Capt. Newt. HARRIS (dec'd), Peter EDWARDS and Nathaniel FRANCIS (Southampton Deed Book 24, p. 301). He thereupon gave a purchase money deed of trust on the property of $1,281.12 on a note. After only seven years, however, James found he could not pay this indebtedness off, and he and his wife Martha conveyed his equity in the property to WILLIAMSON by deed dated December 27, 1845, and recorded April 20, 1846 (Southampton Deed Book 26, p. 529), thereby ending his days as a landowner. Thereafter he continued to farm, either on rented land or for others, on his 1855 marriage license he listed his occupation as "overseer."

    Sometime between 1846 and 1855 Martha Barkley McLemore died, and James took a second wife, a Miss FELTS, according to family tradition. However, no marriage license for this union was ever found. This second wife apparently died, without issue, not too long after that, and in 1855 James married Elizabeth RAMSEY, the daughter of Jacob and Sarah RAMSEY, who was then twenty years his junior. Their marriage took place in Southampton County on June 6, 1855, the Rev. M.A. Longhorn presiding.

    The last record involving this James McLemore is an 1873 chattel mortgage given to Dr. Thomas B. POWELL (Southampton Deed Book 31, p. 612), so it is known that he survived the Civil War. Family records and tradition give his date of death as 1877, but not record of his death appears in the Southampton County court records. Neither he nor his father left wills, nor were their estates administered, which has made the identification of all their children difficult. If he had had a will, however, it may not have helped much, as several of his children died in infancy. The identity of the true mother is not known with respect to several of James' children, much less the correct order of their births, but since only three of his children apparently survived to become married, only their mothers' identities are important and in each case theirs are known.

    Notes:

    "John married Angeline Halbert and lived in Limestone County. John was a small man which served him well during the Civil War. One day he was with his Uncle Maclin Bass McLemore in Rogersville. Maclin was a pilot on the Shoals. The Shoals, being a treacherous body of water and rapids, took a skilled person to navigate. That fateful day John and Maclin were captured by the army. Thinking John was too young (he was 15); he was told to go home and tell his aunt what had happened to her husband.

    John in later years carried the Star Route mail in Limestone County. This mail was carried on horseback for which he received $4.00 a month. He lived in Limestone until his death on Valentine Day in 1924 when he literally dropped dead with a heart attack while walking to the store." (The Heritage of Lauderdale County, Alabama, p. 347).

    Rev. William P. McLemore, in a section on his website devoted to notable McLemore's (Website: http://www.geocities.com/Heartland/Meadows/3476/mclem1.htm), has the following biography:

    Benjamin Franklin McLemore, was born May 3, 1839, the son of James and Martha M. (Barkley) McLemore of southwestern Southampton County. He was apparently one of at least six children born of this union. After completion of his studies, he probably farmed for a while, perhaps with his father, and apparently clerked in a store as well, until the spring of 1861 erupted into this nation's bloodiest conflict, the American Civil War. He survived the entire war with only two slight wounds, was apparently taken with other surrendered southern soldiers to Richmond where he took the amnesty oath on May 18, 1865, and was paroled. He walked home to Southampton County where, by the end of the year he felt secure enough about his future to marry, taking as his wife, Rosa Ann Westbrook, daughter of James David Westbrook and Nancy Lewis (Turner) Westbrook on December 20, 1865, at the bride's home in Drewryville. His wife Rosa, after giving birth to nine children of whom seven survived infancy and six survived to marry and have issue, died on May 26, 1896. B. F. McLemore thereafter married, secondly, Lelia G. Adams, daughter of William T. and Martha P. ("Pullie") Adams of Adams Grove west of Drewryville. This marriage took place on August 3, 1898, in the town of Suffolk in neighboring Nansemond County. Benjamin Franklin McLemore died on January 29, 1911, and was buried between his two wives in the family plot in the cemetery behind the Episcopal Church in Courtland. (B. F.
