    "In the end, Grand-father Noah left everything he owned to his younger son, James Noah. The copies of the legal papers we have, plainly state, in a will written on May 15, 1897:

    First, it is my will that all of my just debts and funeral expenses be paid as soon as convenient after my death.

    Second, it is my will that the said J. N. Boyett, my son, have all my interest in the homestead of one hundred and four acres of land, part of the N. Kelley and part of the A. C. Parmer , said interest to include all the improvements, such as houses, barns etc. After checking birth and death dates, I now know that James Noah was 23 years old when his father willed him all his property and that he was 39 years old when he died so he owned the place about 16 years, depending on whether he sold it or his wife sold it after his death.

    I hereby appoint my brother L. B. Boyett executor of this my last will and it is further my will that no action be taken in the probate court except proof of this will, and filing an inventory of this the property, and no bond be required of my executor. In the testimony of all which I sign my name hereto in the presence of M. Morgan and William Turner.

    So this will was written on May 15, 1897 and fifteen days later, on May 30, 1897, Grand-father Noah Boyett, passed from this earth and was buried beside his beloved wife, Susan, there beside their "Old Boyett Homestead" in Erin, Jasper Co., Texas, where they had lived, loved and reared their large family. They would never know that only one more of their children would be buried there beside them in the quiet of the beautiful countryside they loved so much---the place where they had experienced happy time, times of sorrow, times of loneliness and all the spectrum of emotions, which come to a married couple as they struggle through a lifetime of rearing a family. This pioneering couple also experienced the dreaded separation couples have feared down through the ages? that of war time. Noah was called away to serve in the Civil War. He had to leave his wife and children but fortunately, lived to return home to them. Many others, from that area of Jasper Co., were not as fortunate. They were buried in far away places, never to return to their families."

    Notes:

    Rubye Burkett writes that he was a surveyor by trade, and moved to Texas in 1843. He was the first county clerk of Newton county. One of his first duties was to mark the line between Jasper and Newton counties, as will as furnish a table and chairs for the county court. He married thied Harriet Poole Hall, widow of Britt Hall, and she died soon after their marriage.

    In May of 1855, George, now 70 years of age, and his son Charles Bowman were hauling logs on an ox cart, near the "Wilson Woods place". George had stopped to open a gate and was gored by one of the oxen. His eleven year old son, Charles Bowman, pulled enough logs from the wagon to cover his father and ran for help but George was mortally wounded and there was nothing they could do.

    The inventory of his estate included his surveying tools and maps, four boxes of books, including "Josephus and Cisero." George also taught school, was a member of the State Legislature and a farmer.


    After George's tragic death, Joseph Marshall and Charles Bowman were found living with their half sister, Hester Ann, who was married to Asa Lafitte Stark. The whereabouts of Amanda Catherine and Julia Cassandra at that time are unknown. They may have already been married.

    Notes:

    Ruby Boyett Burkett writes that Ethel Dred Boyett was married three times: to Elizabeth Jane RUSSELL, by whom he had four children: Charlotte, Felix, William, and Eliza Ann BOYETT. He and Sarah SAUCER had six children. He and Nancy PORTER had another six children. He may have been married a fourth time, as at the time of the 1880 Census, his wife, age 36 and born in Georgia, was listed as Margaret.

    In a letter from Nan McCoy Kittell to Melinda Strong on June 25, 1999, Nan wrote "that Ethel Dred Boyette was buried Spring Branch cemetery near Springfield LA with his 3rd wife; his parents believed to be Edward and Rebecca Boyett, Sr." She further wrote that "Boit" is the correct way to pronounce the name, although some family members use "Boy-ett."

    He was shown as Edward at the time of the 1860 Census, as was his namesake son.
